Divisive Concepts Law Found Unconstitutional

A federal court found New Hampshire’s “divisive concepts” law unconstitutional on May 28. 

The US District Court’s opinion found that the prohibition on educators in public schools regarding how race, gender and sexual orientation are discussed was vague, prone to arbitrary enforcement and in violation of the Fourteenth Amendment.

The NH Center for Nonprofits has advocated for repeal of the law. "We urge our lawmakers to recognize the tremendous value of nonprofit educational institutions to our communities and our economy and avoid impeding their ability to provide quality education, community programming, and a critical workforce pipeline," noted Center CEO Kathleen Reardon in prior testimony.
